Introduction
Videographers obviously have a duty to produce the best possible video recording of the marriage of their clients, but in doing so must respect the solemnity of the occasion and the wishes of those involved in delivering the ceremony. In a church, this will be an act of worship as well as a celebration. Cooperation with any officials at the wedding ceremony will undoubtedly result in a better working relationship, and will enable the videographer to acquire the best possible video recording.
Ultimately, the videographer must accept any reasonable terms imposed on them whilst filming in places of worship or civil establishments – and equally ensure that their clients are informed of the effect of any such impositions and restrictions.
Health and Safety
The Videographer should at all times observe current Health & Safety regulations and have due consideration for the safety and welfare of staff, clients and the general public. The videographer should carry out a basic risk assessment prior to the event, noting potential hazards and take action to avoid any health and safety problems.
Insurance
The IOV’s Code of Practice stipulates that all its members undertaken commercial activity must carry adequate
Public Liability and Professional Indemnity insurance. Whilst the Professional Indemnity is important to the client, it would be reasonable for those in places of worship or civil establishments to request to see their Public Liability policy before allowing them to film on their premises.
Copyright
During the course of the ceremony, the videographer will normally record musical works that are copyright – and will need to hold the relevant licence to do this legally. If the music is being performed live, an MCPS LAPL licence is required – which is or the benefit of the Composers and Publishers. It would be reasonable for those in places of worship or civil establishments to request to see the videographer’s MCPS LAPL licence before allowing them to film on their premises.
If there is also pre-recorded music being played or dubbed on the video, then a PPL Video Dubbing Licence would be required in addition – which is for the benefit of the Record Company and Recording Artist.
The copyright of the video recorded a the wedding will remain with the videographer unless agreed otherwise.
